Pat Pizzella, who, along with Jack Abramoff, \u00a0defended worker abuse in the Northern Mariana Islands, is slated to be Deputy Secretary, the number two position at Labor. We&#8217;ve already written about retired coal company executive <a href=\"http:\/\/jordanbarab.com\/confinedspace\/2017\/09\/06\/trump-names-msha-head\/\">David Zatezalo<\/a>, Trump&#8217;s nominee to head MSHA.<\/p>\n<p>And then there&#8217;s\u00a0Cheryl Stanton, the department\u2019s nominee for Wage and Hour administrator, which enforces the nation\u2019s minimum wage, overtime, and other core employment laws. She currently is the head of the South Carolina Department of Employment and Workforce, and previously defended companies over workers while at the law firm Ogletree Deakins.<\/p>\n<p>These are bad enough in and of themselves, but Zatezalo and Stanton replace Joe Main and David Weil, both widely recognized as some of the strongest and most innovative leaders in the history of their respective agencies.<\/p>\n<h2>Meanwhile, Over At EPA&#8230;<\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-577\" src=\"http:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2017\/04\/Pruitt-trump-300x227.jpg\" alt=\"Fox. Pruitt's corporate takeover of EPA\" width=\"300\" height=\"227\" srcset=\"https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2017\/04\/Pruitt-trump-300x227.jpg 300w, https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2017\/04\/Pruitt-trump-768x581.jpg 768w, https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2017\/04\/Pruitt-trump-1024x775.jpg 1024w, https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2017\/04\/Pruitt-trump-800x605.jpg 800w, https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2017\/04\/Pruitt-trump.jpg 1200w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>Meanwhile, a few blocks up Constitution Ave at the <a href=\"http:\/\/thehill.com\/regulation\/administration\/351380-trump-epa-nominee-to-fight-worker-safety-rule-in-court\">Environmental Protection Agency<\/a>, Trump\u2019s pick to head the agency&#8217;s lead air and radiation policy,William Wehrum, will be spending next week arguing on behalf of industry groups in a federal court of appeals against OSHA&#8217;s silica standard. \u00a0An EPA spokesperson saw nothing wrong with Wehrum&#8217;s work next week. After all, the silica lawsuit is all about taking away protections from workers inhaling a cancer causing dust, while his work at EPA will be about\u00a0rolling back rules on carbon dioxide emissions from power plants and ozone pollution. OK then&#8230;.<\/p>\n<p>And just when you thought things couldn&#8217;t get worse, EPA&#8217;s chief Scott Pruitt has nominated industry flack\u00a0<a href=\"https:\/\/www.nytimes.com\/2017\/09\/19\/science\/epa-chemical-industry-dourson.html?hp&amp;action=click&amp;pgtype=Homepage&amp;clickSource=story-heading&amp;module=second-column-region&amp;region=top-news&amp;WT.nav=top-news&amp;_r=0\">Michael L. Dourson<\/a>\u00a0to head the agency&#8217;s Office of Chemical Safety and Pollution Prevention, &#8220;at a time when the E.P.A. is in the early stages of putting in place Congress\u2019s 2016 overhaul of the law governing toxic chemicals.&#8221; Why is this of concern? Dourson ran a consulting firm that represented the American Chemistry Council and many of the nation&#8217;s largest chemical companies whose products have been shown to cause\u00a0severe health issues, like cancer, birth defects and developmental problems in children.<\/p>\n<p>Dr. David Michaels, former head of OSHA and author of <a href=\"http:\/\/&lt;a href=&quot;http:\/\/www.powells.com\/book\/doubt-is-their-product-how-industrys-assault-on-science-threatens-your-health-9780195300673?partnerid=44468&amp;p_ti&quot; title=&quot;More info about this book at powells.com&quot; &gt; Doubt Is Their Product How Industrys Assault on Science Threatens Your Health&lt;\/a&gt;\">Doubt is Their Product<\/a>, knows a mercenary scientist when he sees one. Linking to an article about Dourson, Michaels commented on Facebook: &#8220;Mercenary scientist nominated for leadership position at EPA, charged with protecting the public from toxic chemicals. It is difficult to think of a worse choice for the position.&#8221;<\/p>\n<p>Meanwhile Pruitt is apparently so popular with those of us who have to live on earth, breathe air and drink water, that the agency is being forced to pull environmental law enforcement personnel off of their regular jobs of prosecuting environmental crimes to provide him with <a href=\"\/www.washingtonpost.com\/national\/health-science\/at-epa-guarding-the-chief-pulls-agents-from-pursuing-environmental-crimes\/2017\/09\/19\/7b7b8b6c-9ce0-11e7-8ea1-ed975285475e_story.html?utm_term=.3c31b9cee345\">round-the-clock security protection<\/a>. \u00a0His security detail is triple the size of Obama&#8217;s two EPA administrators.<\/p>\n<h2>The Good News<\/h2>\n<p>OK, if you&#8217;ve read this far, you deserve some good news as a reward. And especially good news for construction workers who have a much better chance of living to retirement thanks to the Obama administration&#8217;s silica standard.<\/p>\n<p>OSHA is scheduled to start enforcing its construction silica standard on September 23. Yes, that&#8217;s the same silica standard mentioned above that will see its day in court next Tuesday. (The Department of Labor, by the way, is defending the standard in court.) \u00a0Enforcement was supposed to begin last June, but the Department delayed the enforcement date by 90 days.<\/p>\n<p>And despite the lawsuit pushed by the ideologues at the Chamber of Commerce and various business associations, BNA reports that t<a href=\"https:\/\/www.bna.com\/builders-tool-industry-n57982088092\/\">he actual construction industry is ready<\/a>\u00a0to protect workers:<\/p>\n<p style=\"padding-left: 30px;\">\u201cIt\u2019s been a long time coming,\u201d Steve Smithgall, senior vice president for operations and safety at Balfour Beatty US, among the nation\u2019s largest general contractors, told Bloomberg BNA. \u201cThey\u2019ve known since the 1940s that silica is bad for people.\u201d<\/p>\n<p style=\"padding-left: 30px;\">At equipment manufacturer Bosch Power Tools, the company\u2019s director of strategic development, Jim Bohn, said he can measure interest in the rule by tracking purchases of tools and attachments designed to prevent silica exposure.<\/p>\n<p style=\"padding-left: 30px;\">\u201cSince the end of July, there\u2019s been a three-fold increase in orders,\u201d Bohn told Bloomberg BNA. \u201c(Buyers) understand what they need.\u201d<\/p>\n<p>So lots of people can literally breathe easier now.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>While the new headlines are all about Hurricanes, health care, North Korea and tax &#8220;reform,&#8221; chickens around the country are getting more and more nervous as the foxes quietly move into the government agencies that are supposed to be protecting them.
