The government (or &#8220;Crown,&#8221; this being Canada) is <a href=\"http:\/\/montrealgazette.com\/news\/local-news\/lac-megantic-criminal-negligence-trial-begins-in-sherbrooke-for-3-accused\">arguing<\/a> that Harding (the engineer and sole crew member) didn&#8217;t set enough hand brakes on the train, Labrie, the rail traffic controller, didn&#8217;t confirm that enough handbrakes were set, and Demaitre, the\u00a0manager of train operations, didn&#8217;t verify that the train was secure after the fire was extinguished and the lead locomotive was shut down.<\/p>\n<p>I have written about this tragedy <a href=\"http:\/\/jordanbarab.com\/confinedspace\/2017\/09\/28\/lac-megantic-blame-worker-steroids\/\">here<\/a>, and how workers are being blamed for what is clearly a failure of management to establish and enforce safe procedures and a safety culture at the railroad. MMA has since gone bankrupt.<\/p>\n<p>Despite the indictments, not everyone is convinced that the right people are on trial. One town resident, Jean Paradis, who narrowly escaped the explosion and lost three friends in the incident, <a href=\"https:\/\/globalnews.ca\/news\/3780159\/are-the-right-people-on-trial-for-lac-megantic-train-disaster\/\">seems to get it<\/a>:<\/p>\n<p style=\"padding-left: 30px;\">He says he doesn\u2019t want answers from the three men on trial; he isn\u2019t happy that MMA executives are \u201cin the States. They\u2019re with their money\u201d and not facing questions in Quebec.<\/p>\n<p style=\"padding-left: 30px;\">\u201cTransport Canada has let those cheap companies run railroads for less money, for making more money instead of acting for security for people,\u201d Paradis told Global News.<\/p>\n<p>Jean-Paul Lacoursi\u00e8re, a chemical engineer at the Universit\u00e9 de Sherbrooke also found that others were to blame &#8212; namely rail management:<\/p>\n<p style=\"padding-left: 30px;\">\u201cIt appears from the TSB report that the company has tolerated improper braking practices, did not provide appropriate braking practice and did not ensure the employees were properly trained and demonstrated that they understood the training,\u201d he told Global News. \u201cThe TSB report indicates that improper repairs were conducted on the locomotive that caught fire the tragic night.\u201d<\/p>\n<p style=\"padding-left: 30px;\">Lacoursi\u00e8re notes the TSB found that MMA lacked leadership by not\u00a0effectively managing risks, implementing safety management systems and providing ineffective training.
