{"id":2423,"date":"2017-12-04T07:41:42","date_gmt":"2017-12-04T12:41:42","guid":{"rendered":"http:\/\/jordanbarab.com\/confinedspace\/?p=2423"},"modified":"2017-12-04T02:05:22","modified_gmt":"2017-12-04T07:05:22","slug":"weird-noise-coming-chipper-osha-trial","status":"publish","type":"post","link":"https:\/\/jordanbarab.com\/confinedspace\/2017\/12\/04\/weird-noise-coming-chipper-osha-trial\/","title":{"rendered":"&#8220;Weird Noise Coming From the Chipper&#8221; as Employee is Dragged to his Death"},"content":{"rendered":"<figure id=\"attachment_2424\" aria-describedby=\"caption-attachment-2424\" style=\"width: 229px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-2424\" src=\"http:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2017\/12\/justus-booze.jpg\" alt=\"Wood Chipper Fatality\" width=\"229\" height=\"221\" \/><figcaption id=\"caption-attachment-2424\" class=\"wp-caption-text\">Justus Booze<\/figcaption><\/figure>\n<p>This <a href=\"https:\/\/altamontenterprise.com\/11022017\/last-moments-relived-day-laborer-who-died-woodchipper\">article<\/a> by Elizabeth Floyd Mair\u00a0of the Altamont Enterprise is a rare summary of a court case involving an employer challenge of an OSHA citation.<\/p>\n<p>This case resulted from an employer&#8217;s contest of a <a href=\"https:\/\/www.osha.gov\/news\/newsreleases\/region2\/11142016\">citation <\/a>for violations related to the gruesome death of a day laborer who was dragged into a wood-chipper in Guilderland, New York\u00a0on\u00a0May 4, 2016. The employer, Tony Watson, owner of Countryside Tree Care, is contesting one willful and four serious citations totaling $141,811 related to the death of Justus Booze, a 23-year old day laborer halfway through his first day on the job.<\/p>\n<p>Read the article. The case describes many of the themes one typically hears in cases like this &#8212; a tragic death, <a href=\"http:\/\/jordanbarab.com\/confinedspace\/category\/blame-the-worker\/\">blaming the worker<\/a>, claiming it was an unavoidable accident, and the search for justice:<\/p>\n<ul>\n<li>The grisly, heartbreaking scene with a co-worker, Brendon John Andres, crying on the witness stand as he described\u00a0\u201ca weird noise coming from the chipper, like it wasn&#8217;t chopping wood\u201d as Booze was dragged into the the rotating blades of the wood-chipper.\u00a0 Andres said he looked down\u00a0and \u201cseen feet hanging out of the chipper.\u201d Booze&#8217;s <a href=\"http:\/\/news10.com\/2016\/05\/19\/fiance-of-man-killed-in-wood-chipper-reflects-on-lost-love\/\">fiance<\/a> was expecting their first child.<\/li>\n<li>The employer&#8217;s attorney stopping &#8220;just short of suggesting that Booze had deliberately jumped into the chipper in a suicide, by asking Watson about an observation Watson had made to investigators just minutes after the death: \u201c&#8217;It was almost like he threw himself into the machine or something, it was that quick.'&#8221;<\/li>\n<li>Watson claiming that the employees had been instructed not to feed wood into the chipper while it was operating despite the fact that OSHA has video of an earlier job where employees were engaged in unsafe practices around the chipper. \u00a0Another worker had testified that the employer had not provided training.<\/li>\n<li>Watson claiming that he\u00a0was overseeing the untrained workers carefully, even though he was cutting wood with a chainsaw and had his back to Booze when the incident happened. According to Department of Labor Attorneys, there was no evidence that Watson intervened once to stop Booze from engaging in unsafe practices.<\/li>\n<li>The employer&#8217;s attorney claiming that there was no negligence and no willful misconduct, no liability, and therefore there should be no penalty.<\/li>\n<li>A local COSH group, the <a href=\"https:\/\/www.facebook.com\/Nenycosh\">North East New York Coalition for Occupational Safety and Health<\/a>, which has met with the Albany County District Attorney&#8217;s office twice in an effort to see that employers are held fully accountable \u2014 both civilly and criminally \u2014 for serious incidents, especially\u00a0fatalities.<\/li>\n<\/ul>\n<p>The <a href=\"https:\/\/www.osha.gov\/ooc\/citations\/CountrysideCitations_1145007.pdf\">citation<\/a> states that:<\/p>\n<p style=\"padding-left: 30px;\">at the three worksites on May 4, 2016, Watson and his crew engaged in unsafe practices, including leaning into and reaching into the infeed hopper; standing to the left of the wood, on the left of the center line of the infeed hopper; pushing small pieces of wood and branches in by hand; and standing in front of the wood chipper, with their backs to it, while manipulating large tree limbs into the infeed hopper.<\/p>\n<p>According to OSHA<\/p>\n<p style=\"padding-left: 30px;\">Since 2011, industry workers have suffered a six-fold increase nationally in the number of amputations &#8211; from 0.5 per 10,000 workers to 3.3 per 10,000 workers. Since 2015, OSHA has received 19 severe injury reports related to wood chippers with injuries including amputations and head trauma. Of those, five occurred because the chipper pulled fingers or arms directly into the blades, and four occurred when a machine&#8217;s belt or pulley caught a body part and pulled it in. The last available report on wood chipper safety shows &#8211; from 1996 through 2005 &#8211; 39 workers died in\u00a0<a title=\"Hazards of Wood Chippers\" href=\"https:\/\/www.osha.gov\/dts\/shib\/shib041608.html\">wood chipper<\/a>\u00a0incidents.
