Earlier this week we learned why. More money and more love.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Norfolk Southern railroad <a href=\"https:\/\/www.prnewswire.com\/news-releases\/norfolk-southern-names-vanessa-l-allen-sutherland-vice-president-law-300671749.html\">announced<\/a> that Sutherland had been hired as Vice President, Legal, for the giant rail corporation.\u00a0Norfolk Southern Railway Co. is a major transporter\/hauler of coal and other commodities serving every major container port in the eastern United States with connections to western carriers. Headquartered in Norfolk, Va., the company employs more than 30,000 union workers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sutherland will likely be making significantly more money than her position as CSB chair, but it\u2019s not likely that her job will be any easier. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Although the company seems to have cleaned up its act, f<\/span><span style=\"font-weight: 400;\">rom 2011 through 2013 OSHA ordered Norfolk Southern to pay compensatory and punitive damages to workers totaling well over $4 million for violating workers\u2019 rights under the whistleblower provisions of the Federal Railroad Safety Act (FRSA).\u00a0\u00a0\u00a0OSHA has no authority over safety and health conditions of America\u2019s rail workers, but the FRSA gives OSHA authority over whistleblower provisions of the law.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Here\u2019s are a couple of typical cases:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">On May 13, 2009, the <a href=\"https:\/\/www.osha.gov\/news\/newsreleases\/region4\/08092011\">employee was initially injured<\/a> in Jamestown, N.C., while removing a spike from the rail line. Fearing loss of employment, the worker did not report the injury until a re-injury occurred in October when, at the suggestion of management, the employee saw a doctor. After returning to work, the employee was suspended and later terminated for allegedly falsifying the injury. The employee submitted a complaint to OSHA and the agency&#8217;s investigation determined that not only were the employee&#8217;s rights under the FRSA violated, the company also successfully intimidated other employees from reporting on-the-job injuries. This &#8220;chilling effect&#8221; allowed Norfolk Southern to maintain the appearance of an exemplary safety record and continue its 22-consecutive-year record as recipient of the E.H.Harriman Gold Medal Rail Safety Award.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">A laborer based in Greenville, S.C., was <a href=\"ttps:\/\/www.osha.gov\/news\/newsreleases\/national\/06182012\">terminated<\/a> on Aug. 14, 2009, after reporting an injury as a result of being hit by the company&#8217;s gang truck. The railroad charged the employee, a laborer, with improper performance of duties. OSHA found that the employee was treated disparately in comparison to four other employees involved in the incident. The laborer was the only employee injured and, thus, the only employee who reported an injury. He also was the only employee terminated.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Happily, things seem to have calmed down since then. Hopefully Sutherland can help keep them that way.<\/span><\/p>\n<h2>Sutherland&#8217;s Legacy<\/h2>\n<p>Sutherland joined the CSB in 2015 promising to calm the waters of the troubled agency and reduce the backlog of unfinished reports that then stood at six. But as Jeff Johnson notes in <a href=\"https:\/\/cen.acs.org\/safety\/industrial-safety\/Changes-tap-US-Chemical-Safety\/96\/web\/2018\/06\">Chemical and Engineering News<\/a>, staff morale problems may be getting worse, and<\/p>\n<p style=\"padding-left: 30px;\">Now, as Sutherland departs, nine accident reports are in process, three more than when she arrived. One of these occurred in 2014, before she took over the board. That accident at a DuPont site involved a chemical process mix-up in which methyl mercaptan was accidentally released, killing four workers. The incident led the Occupational Safety &amp; Health Administration (OSHA) in 2015 to label DuPont a\u00a0<a href=\"https:\/\/cen.acs.org\/articles\/93\/i29\/DuPont-Labeled-Severe-Violator.html\" shape=\"rect\">severe violator<\/a>\u00a0of workplace safety regulations, a consequence that increased enforcement scrutiny and fines. However, CSB has yet to finalize its interim accident report.<\/p>\n<p>After Sutherland&#8217;s departure, Board member <a href=\"https:\/\/www.csb.gov\/dr-kristen-kulinowski-now-serving-as-interim-executive-authority\/\">Dr. Kristen Kulinowski<\/a> was named the agency\u2019s Interim Executive Authority.<\/p>\n<h2>On Her Way Out the Door<\/h2>\n<p>One of Sutherland&#8217;s last acts was\u00a0the final <a href=\"https:\/\/www.peer.org\/news\/news-releases\/outgoing-chemical-safety-chair-fires-managing-director.html\">removal<\/a> of Dr. Daniel Horowitz, who had been CSB Managing Director under former Chair, Dr. Rafael Moure-Eraso. Moure-Eraso\u00a0<a href=\"https:\/\/www.publicintegrity.org\/2015\/03\/27\/16997\/chairman-grossly-mismanaged-chemical-safety-board-resigns\">resigned<\/a> in 2015 while under investigation by Congress and the Inspector General for mismanagement of the agency,\u00a0abuse of power, employee retaliation, lack of honesty in his communications with Congress and use of personal email accounts for agency business. Horowitz had been on administrative leave since Moure-Eraso&#8217;s resignation.<\/p>\n<p>Meanwhile, President Trump has proposed for the second year in a row that the small agency be eliminated and although it is unlikely that Congress will go along, constant threats of execution by firing squad can&#8217;t be good for staff morale or the agency&#8217;s ability to fill vacancies.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Last month, without any warning or explanation, Vanessa Sutherland announced her resignation as Chair of the Chemical Safety Board.
