\"Kavanaugh\"After President Trump nominated Brett Kavanaugh to the Supreme Court, I wrote a post<\/a> describing his anti-worker dissent in the SeaWorld case. In response, a commenter<\/a> called me “a far left activist [who] has always opposed any politician, judge, or person who has an alternative view.”<\/p>\n

Well I would heartily disagree with that characterization, but however people want to characterize me,\u00a0 I’m happy to point out that there are many other smart, well educated people out there who agree that Kavanaugh will be a disaster for working people.<\/p>\n

Below are a series of additional articles written by labor and business experts across the country about the damage that Kavanaugh is expected to wreak on workers and labor.<\/p>\n

The Kavanaugh Nomination and Labor<\/a>, by Sharon Block, OnLabor<\/em><\/h3>\n

Comment: Block, Executive Director of the Labor and Worklife Program at Harvard Law School, does a detailed analysis of several labor-related cases that Kavanaugh has ruled on in order to “make the case that his record reflects a sustained and, at times, aggressive hostility to the role of the law in protecting the vulnerable and\u00a0less\u00a0powerful.”\u00a0 Noting that the AFL-CIO opposes Kavanaugh’s appointment, Block writes that “Opposition to the nomination by the labor movement is no surprise.\u00a0 Kavanaugh\u2019s record demonstrates consistent support for the interests of employers and a lack of concern for the interests of workers and the government agencies that come to the D.C. Circuit to protect workers\u2019 rights.”<\/p>\n

The judicial jihad against the regulatory state<\/a>, by Steven Pearlstein, the Washington Post<\/em><\/h3>\n<\/div>\n<\/div>\n
Comment: Long-time Washington Post business columnist Steve Pearlstein describes Kavanaugh’s current court, the DC Circuit, “where a new breed of activist judges are waging a determined and largely successful war on federal regulatory agencies.”\u00a0 Discussing a recent case where Kavanaugh wrote an opinion throwing out the EPA air pollution requirements, Pearlstein writes: “What you get is 60 pages of legal sophistry, procedural hair-splitting and scientific conjecture.\u00a0 You find a judge without a shred of technical training formulating his own policy solution to an incredibly complex problem and substituting it for the solution proposed by experienced experts. You find an appeals court judge so dismissive of the most fundamental rules of judicial restraint that he dares to throw out regulations on the basis of concerns never raised during the rule-making process or in the initial court appeal.” Ouch!<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/section>\n

Brett Kavenaugh Ruled Against Workers When No One Else Did<\/a>, by Dave Jamieson, Huffington Post<\/em><\/h3>\n

Comment: In addition to my post on the Sea World case<\/a>, Jamieson discusses the Agri Processors case where the meatpacker refused to bargain with the newly elected union, arguing that most of them weren\u2019t covered by collective bargaining law because they were undocumented immigrants. “Ultimately, neither the National Labor Relations Board nor the majority of judges on a panel for the U.S. Court of Appeals for the District of Columbia Circuit agreed with Agri Processor. The only one who did was Brett Kavanaugh.”<\/p>\n

Trump\u2019s Supreme Court Pick Could Spell a Fresh Hell for Workers\u2019 Rights<\/a>, by Moshe Marvit, In These Times<\/em><\/h3>\n

Comment: Marvit goes through a number of labor related cases where he consistently ruled against workers and labor unions. He concludes that “Labor advocates should be extremely concerned about this ideological bent if Kavanaugh becomes a justice on an already very business friendly\u2014and conservative\u2014Supreme Court.”<\/p>\n

Trump asks business groups for help pushing Kavanaugh confirmation<\/a>, by Lorraine Woellert, Politico<\/em><\/h3>\n

Comment: The White House is asking business groups to help with Kavanaugh’s confirmation because “\u201cJudge Kavanaugh protects American businesses from illegal job-killing regulation.\u201d Enough said.<\/p>\n

Watch Out Workers, Here Comes Brett Kavanaugh<\/a>, by Andrew Strom, OnLabor<\/em><\/h3>\n

Comment: Strom is\u00a0Associate General Counsel of Service Employees International Union (SEIU), and being an actual attorney is able to describe the legal issues of the Sea World case much better than I could.\u00a0 Strom thinks that ”\u00a0If the Senate confirms Kavanaugh\u2019s nomination, we can expect repeated instances where he will similarly insist that the agencies that Congress created to protect workers and the general public somehow overstepped\u00a0their\u00a0authority.”<\/p>\n

Trump\u2019s Supreme Court nominee hostile to OSHA<\/a>, by Celeste Monforton, DrPH, MPH, The Pump Handle<\/em><\/h3>\n<\/header>\n
Comment: Monforton discusses the Sea World case, relying heavily on my post in describing the Sea World case for her readers.<\/div>\n<\/div>\n

Family Man Brett Kavanaugh Thinks Businesses Shouldn’t Be Liable If Employee Are Eaten on the Job<\/a>, by Bess Levin, Vanity Fair<\/em>.<\/h3>\n

Comment: Vanity Fairs wins the prize for the best headline. Dawn Brancheau was not actually eaten by the whale; just dismembered and drowned. But even if she had been consumed, I doubt that would change Kavenaugh’s opinion about the legality of OSHA’s citation against Sea World.<\/p>\n
