{"id":3806,"date":"2018-09-10T08:20:57","date_gmt":"2018-09-10T12:20:57","guid":{"rendered":"http:\/\/jordanbarab.com\/confinedspace\/?p=3806"},"modified":"2019-07-19T13:38:19","modified_gmt":"2019-07-19T17:38:19","slug":"kavanaughs-lies-seaworld","status":"publish","type":"post","link":"https:\/\/jordanbarab.com\/confinedspace\/2018\/09\/10\/kavanaughs-lies-seaworld\/","title":{"rendered":"Kavanaugh&#8217;s Lies About SeaWorld: Annotated"},"content":{"rendered":"<p><span style=\"font-weight: 400;\"><br \/>\n<img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-3829\" src=\"http:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2018\/09\/Seaworld-300x200.jpg\" alt=\"Kavanaugh SeaWorld\" width=\"300\" height=\"200\" srcset=\"https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2018\/09\/Seaworld-300x200.jpg 300w, https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2018\/09\/Seaworld-768x511.jpg 768w, https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2018\/09\/Seaworld.jpg 780w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>Allow me to be blunt: Judge Brett Kavanaugh lied about the SeaWorld case during his Senate Confirmation testimony last week and he showed very little understanding of the Occupational Safety and Health Act.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Being as Judge Kavanaugh is a great <a href=\"https:\/\/www.forbes.com\/sites\/bobcook\/2018\/09\/05\/one-thing-we-know-about-brett-kavanaugh-hes-a-girls-basketball-coach\/#37b7119c3946\">girls basketball coach<\/a> in the <a href=\"https:\/\/www.mcsweeneys.net\/articles\/i-too-grew-up-in-the-crime-ridden-streets-of-bethesda-maryland\">crime-ridden streets<\/a> of Bethesda, Maryland, however, these facts probably won&#8217;t make much difference to Republicans in his confirmation vote. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">But for those who take the Supreme Court &#8212; and workers&#8217; rights &#8212; seriously, the facts are the facts. And these facts should be very troubling for American workers.<\/span><\/p>\n<blockquote><p><span style=\"color: #000080;\"><strong> I can&#8217;t figure out how the lies in Kavanaugh&#8217;s testimony or his legal misunderstanding of the OSHAct would get a passing grade in the first year of law school, much less a lifetime seat on the Supreme Court of the United States. <\/strong><\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">In case you&#8217;re just tuning in, in 2010 SeaWorld killer whale trainer Dawn Brancheau was dismembered and killed by a killer whale during a live show in front of hundreds of horrified customers, including small children. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">OSHA, which had proven that SeaWorld was aware that the whale that killed Brancheau, had been involved in previous trainer fatalities, and that killer whales in general were hazardous to trainers, cited SeaWorld and ordered them to use physical barriers or minimum distances to separate trainers from whales. SeaWorld appealed, and both the OSHA Review Commission and the federal Appeals Court found in OSHA&#8217;s favor. The only dissent throughout the entire process was Appeals Court Judge Brett Kavanaugh who argued in his 2014\u00a0<a href=\"https:\/\/www.cadc.uscourts.gov\/internet\/opinions.nsf\/5AF8A4C12F19AE2185257CB700516292\/$file\/12-1375-1487925.pdf\">written opinion<\/a> that OSHA had paternalistically interfered in a worker&#8217;s right to risk his or her life in a hazardous workplace, that OSHA had violated its long-standing precedent not to get involved in sports or entertainment, that the agency had no authority to regulate in the sports or entertainment industries and that Congress &#8212; and only Congress &#8212; could give OSHA that authority.<\/span><\/p>\n<p>(You can read my original post about the SeaWorld decision\u00a0<a href=\"http:\/\/jordanbarab.com\/confinedspace\/2018\/07\/10\/kavanaugh-threat-to-osha-workers\/\">here<\/a>, and an excellent piece by my former OSHA colleague Deborah Berkowitz <a href=\"https:\/\/www.nelp.org\/blog\/if-you-work-in-a-dangerous-job-you-should-be-worried-about-brett-kavanaugh\/\">here<\/a>.)<\/p>\n<p>So, let&#8217;s fast-forward to last Thursday, when Kavanaugh was questioned about his SeaWorld dissent by Senator Diane Feinstein (D-CA) during his Supreme Court confirmation hearing. You can watch and listen<span style=\"font-weight: 400;\">\u00a0to the exchange beginning at 1:42:16 of Thursday\u2019s hearing <a href=\"https:\/\/www.judiciary.senate.gov\/meetings\/nomination-of-the-honorable-brett-m-kavanaugh-to-be-an-associate-justice-of-the-supreme-court-of-the-united-states-day-3\">here<\/a>.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\"><strong><span style=\"text-decoration: underline;\">Senator Feinstein<\/span><\/strong>: &#8220;Judge Kavanaugh, y<em>ou sat on a case where a trainer, Dawn Brancheau, was killed while interacting with a killer whale during a live performance. Following her death, the Occupational Safety and Health Administration found that SeaWorld had violated workforce safety laws. The majority agreed with the agency, that SeaWorld had violated the law. According to what I know, you disagreed. In your dissent, you argued that the agency lacked the authority to regulate employers to protect participants in sporting events or entertainment shows. \u00a0However the statute, as enacted, applies to each employer and it defined employer as anyone engaged in business affecting commerce who has employees. <\/em><\/span><\/p>\n<p style=\"padding-left: 30px;\"><em><span style=\"font-weight: 400;\">Where in the text of the law does Congress exempt employers of animal trainers?&#8221;<\/span><\/em><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\"><strong><span style=\"text-decoration: underline;\">Judge Kavanaugh<\/span>:<\/strong> &#8220;<\/span><i><span style=\"font-weight: 400;\">The issue, Senator, was <strong>precedent<\/strong>. I follow, as a judge,<strong> I follow precedent.<\/strong> <strong>The precedent <\/strong>o<strong>f the Labor Department<\/strong>, as I read it, was that the Labor Department under the statute would not regulate what it called <strong>the intrinsic qualities <\/strong>of a sports or entertainment show.&#8221;\u00a0<\/span><\/i><span style=\"font-weight: 400;\">[emphasis added]<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There are several problems in Kavanaugh&#8217;s statement.\u00a0<\/span><\/p>\n<h3><b>There is no precedent for OSHA not regulating the entertainment industry.<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Just the opposite, in fact. \u00a0OSHA has cited circuses and Broadway musicals several times due to deaths and injuries of performers. For example:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">In 2011 OSHA issued three serious <\/span><a href=\"https:\/\/www.osha.gov\/news\/newsreleases\/region2\/03042011\"><span style=\"font-weight: 400;\">citations<\/span><\/a><span style=\"font-weight: 400;\"> and a $12,600 fine to 8 Legged Productions LLC following four separate incidents that resulted in injuries to cast members of the musical \u00a0&#8220;Spider-Man Turn Off the Dark.&#8221;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">In June 2013, Nevada OSHA <\/span><a href=\"https:\/\/www.osha.gov\/pls\/imis\/establishment.inspection_detail?id=316844711\"><span style=\"font-weight: 400;\">fined<\/span><\/a><span style=\"font-weight: 400;\"> Cirque du Soleil $23,035 for five violations after a performer in the show \u201cKa\u201d at the MGM Grand Hotel and Casino in Las Vegas was killed after falling 94 feet during a show. The wire rope attached to her harness broke because it was scraping against a sharp edge.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">In November 2014, Federal OSHA <\/span><a href=\"https:\/\/www.osha.gov\/pls\/imis\/establishment.inspection_detail?id=975518.015\"><span style=\"font-weight: 400;\">cited<\/span><\/a><span style=\"font-weight: 400;\"> the Ringling Bros. and Barnum &amp; Bailey Circus after eight performers fell more than 15 feet during the \u201chair hang act\u201d as they were suspended from a twirling frame by their hair. According the OSHA <\/span><a href=\"https:\/\/www.osha.gov\/doc\/engineering\/2014_r_05.html#7\"><span style=\"font-weight: 400;\">investigation<\/span><\/a><span style=\"font-weight: 400;\">, \u201cThe hair hang act was advertised as a spectacular and thrilling act to perform and watch. Six performers are hung from their hair from an overhead hexagonal steel framed apparatus.\u201d OSHA determined that a steel carabiner holding the performers was not strong enough to support their weight.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">OSHA Is currently <\/span><a href=\"https:\/\/www.bna.com\/cirque-du-soleil-n57982090030\/\"><span style=\"font-weight: 400;\">investigating<\/span><\/a><span style=\"font-weight: 400;\"> the death of a Cirque du Soleil performer in Tampa, Florida after he fell during an aerial act<\/span><\/li>\n<\/ul>\n<p>One other thing. Kavanaugh was not only wrong, but he was just making stuff up: SeaWorld didn&#8217;t even argue that its whale trainers weren&#8217;t covered by OSHA because they were in the entertainment business. It wasn&#8217;t part of the case until Kavanaugh raised the issue.<\/p>\n<h3><strong>Kavanaugh Lied About What He Wrote In His SeaWorld Dissenting Opinion<\/strong><\/h3>\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\"><strong><span style=\"text-decoration: underline;\">Judge Kavanaugh to Senator Feinstein<\/span>:<\/strong> &#8220;<\/span><i><span style=\"font-weight: 400;\">The Labor Department in the oral arguments tried to distinguish, for example, the dangers of football from the dangers of the SeaWorld show and I did not, as I explained in the opinion find that argument persuasive.<\/span><\/i><\/p>\n<p style=\"padding-left: 30px;\"><i><span style=\"font-weight: 400;\">But I did make clear two things, Senator. One is \u2026 that Congress could make the decision to regulate the intrinsic qualities of sports or entertainment shows,\u00a0<strong>or the Labor Department could change its precedent..<\/strong>.&#8221;<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Actually, Kavanaugh is lying here. He made one of those things very clear in his <a href=\"https:\/\/www.cadc.uscourts.gov\/internet\/opinions.nsf\/5AF8A4C12F19AE2185257CB700516292\/$file\/12-1375-1487925.pdf\">SeaWorld dissent<\/a>:\u00a0 that <em>o<\/em><em>nly<\/em> Congress can allow OSHA to regulate sports or entertainment and <em>only<\/em> by changing the law. The Department of Labor, he wrote in his dissent, did <em>not<\/em> have the authority to cover sports or entertainment because Congress hadn&#8217;t intended these kinds of occupations to be covered when the Occupational Safety and Health Act (OSHAct) was passed. He wrote in his 2014 dissent:\u00a0\u00a0<\/span><\/p>\n<p style=\"padding-left: 30px;\"><em><strong>In the real world, it is simply not plausible to assert that Congress, when passing the Occupational Safety and Health Act, silently intended to authorize the Department of Labor to eliminate familiar sports and entertainment practices<\/strong>, such as punt returns in the NFL, speeding in NASCAR, or the whale show at SeaWorld.\u00a0<\/em><\/p>\n<p style=\"padding-left: 30px;\"><em>To the extent sports or entertainment activities raise concerns about the risk of injury to the participants, several extant legal bodies possess significant authority to clamp down on unreasonable dangers: Congress, state legislatures, state regulators, courts applying state tort law. I take no position here on whether SeaWorld\u2014or for that matter the NFL or NASCAR\u2014should be subject to more stringent government regulation or liability, or otherwise should voluntarily make its activities safer. That policy question is not before us. <strong>My legal disagreement with the majority opinion boils down to one basic question: Who decides?<\/strong> Under current law, it is <strong>not<\/strong> the Department of Labor. <\/em>[emphasis added.]<\/p>\n<p><span style=\"font-weight: 400;\">So can the Department of Labor change OSHA&#8217;s (non-existent) precedent, or can only Congress change OSHA&#8217;s (non-existent) precedent? It apparently depends on which Brett Kavanaugh you&#8217;re talking to and which day you&#8217;re talking to him.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nor does Kavanaugh explain exactly how OSHA would \u201cchange its precedent.\u201d Obviously he didn&#8217;t consider issuance of a citation against SeaWorld to be adequate. Maybe this would work:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-3811\" src=\"http:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2018\/09\/Seaworld-Plane.jpg\" alt=\"kavanaugh\" width=\"689\" height=\"266\" srcset=\"https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2018\/09\/Seaworld-Plane.jpg 1004w, https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2018\/09\/Seaworld-Plane-300x116.jpg 300w, https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2018\/09\/Seaworld-Plane-768x296.jpg 768w, https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2018\/09\/Seaworld-Plane-800x308.jpg 800w\" sizes=\"auto, (max-width: 689px) 100vw, 689px\" \/><\/p>\n<h3><b>The OSHAct Covers All Employees &#8212; Including Animal Trainers<\/b><\/h3>\n<p>Kavanaugh never really answers Feinstein&#8217;s direct question about where the OSHAct says that employers of animal trainers are not covered by the law. Because the OSHAct clearly states that <em>all<\/em> employees are covered by OSHA (with the exception of public employees.)<\/p>\n<p>To put it bluntly, Kavanaugh&#8217;s statement in his testimony and in his SeaWorld dissent are not only wrong, but are also sheer hypocrisy. He claims to be a &#8220;textualist,&#8221; that is a jurist who\u00a0gives primacy to the ordinary meanings of the words of a statute, and steers away from other sources of meaning, like legislative history. So it is unclear how textualism is consistent with his speculation on what Congress <em>plausibly intended<\/em>\u00a0&#8212; but never actually <em>said &#8212; <\/em>fifty years ago when the OSHAct was passed. As Wharton Professor (and former OSHA official) Adam Finkel stated, &#8220;&#8216;Textualist&#8217; Brett Kavanaugh\u00a0<i>made up out of nowhere\u00a0<\/i>language he personally\u00a0<em>wished\u00a0<\/em>Congress had written, but never did.&#8221;<\/p>\n<h3><b>Kavanaugh misuses the word \u201cintrinsic.\u201d <\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Kavanaugh states that OSHA is not allowed to regulate <i>the intrinsic qualities <\/i>of a sport or entertainment show.&#8221; But \u201cintrinsic,\u201d according to <\/span><a href=\"https:\/\/www.merriam-webster.com\/dictionary\/intrinsic\"><span style=\"font-weight: 400;\">Merriam-Webster<\/span><\/a><span style=\"font-weight: 400;\">, is defined as \u201cbelonging to the <em>essential nature<\/em> or constitution of a thing.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-3579\" src=\"http:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2018\/07\/kavanaugh-300x225.jpg\" alt=\"Kavanaugh\" width=\"300\" height=\"225\" srcset=\"https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2018\/07\/kavanaugh-300x225.jpg 300w, https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2018\/07\/kavanaugh.jpg 644w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>Now, one might make a convincing argument that tackling is \u201cintrinsic\u201d or \u201cessential\u201d to professional football. (Although there is still nothing in the law prohibiting OSHA from regulating the safety of football, even if the agency has chosen not to do so.)<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But is close personal contact between trainers and the killer whales during performances \u201cintrinsic\u201d or \u201cessential\u201d to SeaWorld\u2019s killer whale shows?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The answer is no. The main attraction of whale shows is watching the whales jump out of the water, do clever tricks and splash the spectators. Sure, the audience may also enjoy watching the trainers hug and cuddle the whales, but the show goes on even without the close, personal contact, as SeaWorld itself admits by the fact that they are\u00a0<\/span><a href=\"https:\/\/seaworld.com\/orlando\/shows\/one-ocean\/\"><span style=\"font-weight: 400;\">continuing to allow their customers to \u201cjourney into the world of majestic killer whales\u201d<\/span><\/a><span style=\"font-weight: 400;\"> without the close contact between the whales and the trainers. People still seem to enjoy the show even without the opportunity to watch a trainer get killed during the performance.<\/span><\/p>\n<h3><strong>Kavanaugh is Wrong: OSHA is permitted to regulate in &#8220;new&#8221; areas that Congress didn&#8217;t specifically mention 50 years ago.<\/strong><\/h3>\n<p><span style=\"font-weight: 400;\">The possibility OSHA might be confronted by &#8220;new&#8221; hazards that Congress did not foresee in 1970, or hazards for which there was no specific OSHA standard, was clear to the founding fathers of the Occupational Safety and Health Act (OSHAct) when the law was passed almost 50 years ago.\u00a0 <\/span><\/p>\n<p><span style=\"font-weight: 400;\">To ensure that OSHA would be able to require employers to protect workers from these &#8220;new&#8221; hazards, the OSHAct contains the \u201cGeneral Duty Clause\u201d(Section 5(a)(1)), which enables OSHA to cite employers for exposing employees to hazards for which there are no standards as long as the hazard was \u201crecognized\u201d (by the employer or by the industry) and where there was a \u201cfeasible&#8221; means of preventing or reducing the hazard. SeaWorld was\u00a0<a href=\"https:\/\/www.osha.gov\/pls\/imis\/establishment.violation_detail?id=314336850&amp;citation_id=02001\">cited<\/a>\u00a0under OSHA&#8217;s General Duty Clause because the hazard of killer whales was well recognized by SeaWorld (and the industry), and because it was perfectly feasible to carry on with whale shows without exposing the trainers to death and dismemberment.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Furthermore, &#8220;new&#8221; hazards have also never been a legal problem for OSHA before. Many serious hazards facing workers today were not envisioned when the OSHAct was passed in 1970, but OSHA still regulates those hazards. Workplace violence and ergonomics are two examples of \u201cnew\u201d hazards that are regularly cited under OSHA&#8217;s General Duty Clause. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The legislators that wrote the OSHAct most likely never predicted that infectious diseases might be an area that OSHA would someday regulate.\u00a0 And indeed, OSHA&#8217;s Bloodborne Pathogens standard, issued in 1990, was initially opposed because because infectious diseases were an area that OSHA had never regulated before the scourges of HIV\/AIDS and hepatitis B started killing health care workers in large numbers.\u00a0 Yet today, thanks to OSHA&#8217;s ability to regulate in areas that Congress never foresaw, thousands of health care workers owe their lives to OSHA&#8217;s Bloodborne Pathogens standard.<\/span><\/p>\n<h3><b>Kavanaugh is Wrong: Whale training is not a sport. <\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Killer whale shows are not sports. Whale trainers are not athletes; they\u2019re workers in the entertainment industry. There is no fight between whale and human (or there shouldn\u2019t be). No one is trying to win. No one keeps score. No one is supposed to get hurt. No one is supposed to die.<\/span><\/p>\n<blockquote><p><span style=\"color: #0000ff;\"><strong>Killer Whale shows are not sports. There is no fight between whale and human (or there shouldn\u2019t be). No one is trying to win. No one keeps score. No one is supposed to get hurt. No one is supposed to die.<\/strong><\/span><\/p><\/blockquote>\n<h3>Kavanaugh is Wrong: Tort Law is not a substitute for laws that prevent workers from getting hurt on the job<\/h3>\n<p><span style=\"font-weight: 400;\">The use of lawsuits as the only recourse for workers in unsafe jobs went out of fashion (and law) 100 years ago. One would think that Kavanaugh, as a distinguished jurist being considered for the Supreme Court, would be aware that ever since the creation of workers compensation laws in the early part of the 20th century, employees have generally not been allowed to sue their employers after being hurt on the job. And the whole point of the OSHAct is to make the workplace safe\u00a0<em>before\u00a0<\/em>workers get hurt, not after it&#8217;s too late.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So the following statement from Kavanaugh was confusing, to say the least:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><strong><span style=\"text-decoration: underline;\">Kavanaugh to Feinstein<\/span><\/strong><i><span style=\"font-weight: 400;\">: &#8220;&#8230;and I made clear that of course, state tort law, as the NFL has experienced with the concussion issue, state tort law always exists as a way to ensure or help ensure safety in the SeaWorld show.&#8221;<\/span><\/i><\/p>\n<p>Huh?<\/p>\n<h3><strong>Conclusion<\/strong><\/h3>\n<p>In his SeaWorld dissent, Kavanaugh asked:<\/p>\n<p style=\"padding-left: 30px;\"><em>When should we as a society paternalistically decide that the participants in these sports and entertainment activities must be protected from themselves\u2014that the risk of significant physical injury is simply too great even for eager and willing participants?<\/em><\/p>\n<p style=\"padding-left: 30px;\"><em>And most importantly for this case, who decides that the risk to participants is too high?<\/em><\/p>\n<p>When?\u00a0 In 1970, with the passage of the Occupational Safety and Health Act that gave employers the legal responsibility to provide a safe workplace for their employees.<\/p>\n<p>Who decides? Congress and then-President Richard Nixon decided, almost fifty years ago with the passage of the OSHAct and the creation of the Occupational Safety and Health Administration.<\/p>\n<p>In that sentence Kavanaugh undermines the OSHAct&#8217;s clear guarantee of a safe workplace to every worker, and the employer&#8217;s responsibility to provide that safe workplace.<\/p>\n<p><span style=\"font-weight: 400;\">Now I&#8217;m no lawyer, nor am I a professor of law, but I can&#8217;t figure out how the lies in Kavanaugh&#8217;s testimony or his legal misunderstanding of the OSHAct would get a passing grade in the first year of law school, much less a lifetime seat on the Supreme Court of the United States. He has\u00a0<\/span>made clear that he does not believe in the mission of OSHA, the goals of the Occupational Safety and Health Act or what Congress actually said in the law, despite his claim to be a textualist.<\/p>\n<p>He has shown himself, under sworn testimony, to be willing to make up facts and legal theories out of thin air to support his corporate-first ideology.<\/p>\n<p>He is not fit for the Supreme Court.<\/p>\n<p>Steven Pearlstein&#8217;s recent description in the <a href=\"https:\/\/www.washingtonpost.com\/business\/the-judicial-jihad-against-the-regulatory-state\/2012\/10\/12\/d9eb080c-13ca-11e2-bf18-a8a596df4bee_story.html?utm_term=.69d1d2bd29b0\">Washington Post<\/a> of Kavanaugh&#8217;s opinion about an environmental law could have been written about the SeaWorld case:<\/p>\n<p style=\"padding-left: 30px;\">What you get is 60 pages of legal sophistry, procedural hair-splitting and scientific conjecture.\u00a0 You find a judge without a shred of technical training formulating his own policy solution to an incredibly complex problem and substituting it for the solution proposed by experienced experts. You find an appeals court judge so dismissive of the most fundamental rules of judicial restraint that he dares to throw out regulations on the basis of concerns never raised during the rule-making process or in the initial court appeal.<\/p>\n<p>As Debbie Berkowitz wrote in her NELP <a href=\"https:\/\/www.nelp.org\/blog\/if-you-work-in-a-dangerous-job-you-should-be-worried-about-brett-kavanaugh\/\">post<\/a>, &#8220;If you work in a dangerous job, you should be worried about Brett Kavanaugh.&#8221;<\/p>\n<p>Very worried.<\/p>\n<p>**************************************<\/p>\n<p><span style=\"color: #ff0000;\">P.S.
