Just to add insult to physical injury, USDA issued the notice without even seeking public input.<\/p>\n<p>Rep. Rosa DeLauro\u00a0(D-Conn) is not amused: &#8220;It is unconscionable that the Trump administration would rush this process, without an ample opportunity for the public to weigh in. I urge the Trump administration to reverse course.&#8221;\u00a0This action has been <a href=\"http:\/\/jordanbarab.com\/confinedspace\/2017\/09\/19\/disabled-discarded-poultry-workers\/\">under consideration<\/a> for a while. DeLauro joined Senator Patty Murray (D-Wash) in <a href=\"http:\/\/jordanbarab.com\/confinedspace\/2017\/11\/17\/murray-delauro-call-usda-poultry\/\">sending a letter to USDA<\/a>\u00a0last July, stating that &#8220;it appears the agency lacks the authority to grant these waivers&#8221;\u00a0 and urged the agency to abandon the policy.<\/p>\n<p>According to Politico&#8217;s <a href=\"https:\/\/www.politico.com\/newsletters\/morning-shift\/2018\/09\/27\/not-safe-for-kids-353952\">Morning Shift<\/a>,<\/p>\n<p style=\"padding-left: 30px;\">The policy establishes\u00a0criteria to allow poultry plants to receive waivers to raise line speeds from 140 to 175 birds per minute. &#8220;We are stunned that they are not doing this through rulemaking or requesting any comment,&#8221; Debbie\u00a0<span class=\"il\">Berkowitz<\/span>, a former policy adviser at OSHA who&#8217;s now with the National Employment Law Project, said in a written statement to Morning Shift. &#8220;This action clearly undermines the rulemaking process, violates the Administrative Procedures Act, and is inconsistent with the agency&#8217;s own regulations.&#8221;<\/p>\n<p style=\"padding-left: 30px;\">But\u00a0according to a FSIS spokesperson, FSIS has &#8220;evaluated and granted&#8221; such waivers &#8220;for many years&#8221; and its &#8220;regulations include provisions&#8221; for those waivers. &#8220;This process for granting waivers has not changed,&#8221; a FSIS spokesperson said in a statement. &#8220;In an effort to ensure complete transparency, the agency is choosing to publicly announce the criteria by which we will review line speed waivers, so there is no question about how the agency makes its decisions.&#8221;<\/p>\n<h2>And Hog Workers<\/h2>\n<p>And if chickens aren&#8217;t enough, USDA is also considering increasing line speeds in hog slaughterhouses, as we <a href=\"http:\/\/jordanbarab.com\/confinedspace\/2018\/04\/19\/fox-watching-the-hog-house\/\">reported last April<\/a>.\u00a0The United Food and Commercial Workers union has sent a <a href=\"http:\/\/www.ufcw.org\/2018\/09\/27\/ufcw-requesting-usda-to-reopen-comments-on-pork-line-speed-rule\/\">letter<\/a> to USDA\u00a0 requesting more time for the public to weigh in on a proposed rule to lift a cap on line speeds. UFCW argues that USDA did not release the injury data and analysis to the public prior to the comment period closing on May 2. According to Politico&#8217;s <a href=\"https:\/\/www.politico.com\/newsletters\/morning-shift\/2018\/09\/27\/not-safe-for-kids-353952\">Morning Shif<\/a>t,\u00a0 USDA&#8217;s\u00a0Food Safety and Inspection Service<\/p>\n<p style=\"padding-left: 30px;\">published a\u00a0<a href=\"https:\/\/www.fsis.usda.gov\/wps\/wcm\/connect\/bcb2cbd3-0631-489d-8bf3-e5b79fe39020\/Peer_Review_Plan_FSIS-Hog-Slaughter-Risk-Assessment.pdf?MOD=AJPERES\" target=\"_blank\" rel=\"noopener\">peer review plan<\/a>\u00a0in May, indicating that the review would be completed by July 2018. The\u00a0<a href=\"https:\/\/www.fsis.usda.gov\/wps\/wcm\/connect\/61f79c11-eb82-435f-bb3e-d5d97b103519\/Market-Hog-Risk-Assessment-Updated-080318.pdf?MOD=AJPERES\" target=\"_blank\" rel=\"noopener\">final peer reviewed risk assessment<\/a>\u00a0was published on FSIS\u2019 website Aug. 3. UFCW argues that the data \u201cwere never provided to permit careful scrutiny by the public in order to provide comment on this aspect of the proposed rule.\u201d<\/p>\n<h2>And Children<\/h2>\n<p>Labor rights and children&#8217;s&#8217; advocates are condemning a Labor Department rule that would\u00a0allow 16- and 17-year-old nursing-home workers to operate power-driven patient lifting devices without any adult supervision or assistance. According to <a href=\"https:\/\/www.nelp.org\/news-releases\/dols-ill-advised-proposal-repeal-child-labor-protections-nursing-homes-hospitals\/\">NELP&#8217;s Deborah Berkowitz<\/a>,<\/p>\n<p style=\"padding-left: 30px;\">The Department of Labor is deliberately ignoring the clear expert and scientific evidence about the danger of young workers using these devices unattended.\u00a0 Although NELP supports the goal of providing more job-training and apprenticeship opportunities for young workers who wish to enter the health care field, we cannot do so at the expense of those very workers\u2019 health and safety and the health and safety of nursing home residents.\u00a0 This proposed rule presents far more danger than benefits to young workers and, as such, NELP must oppose its implementation.<\/p>\n<p>Berkowitz points out that the National Institute for Occupational Safety and Health concluded in 2011 that &#8220;many 16- and 17-year-old employees cannot safely operate power-driven hoists to lift and transfer patients\u00a0<em>by themselves.<\/em>&#8221; They aren&#8217;t able to adequately assess the hazards and allowing them to operate the equipment themselves &#8220;would\u00a0put them at increased risk for serious musculoskeletal injuries.&#8221; NIOSH recommended that the youngsters be assisted by an\u00a0experienced caregiver who is at least 18 years of age.<\/p>\n<p>The Department is justifying its action under the guise of providing more apprenticeships for young workers. OK.<\/p>\n<h2>Get the Lead Out &#8212; Or Not<\/h2>\n<p>Meanwhile, in California,\u00a0Gov. Jerry Brown (D) vetoed legislation that would have ensured that CalOSHA inspectors are made aware of dangerous workers lead exposure. <a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201720180AB2963\">California Assembly Bill 2963<\/a>\u00a0would have required the state\u2019s public health agency to notify CalOSHA of blood tests showing high lead levels.<\/p>\n<p class=\"m_-204109308835557363gmail-\">According to <a href=\"https:\/\/news.bloombergenvironment.com\/safety\/brown-vetoes-california-workplace-lead-exposure-bill\">Bloomberg Environment<\/a>,<\/p>\n<p class=\"m_-204109308835557363gmail-\" style=\"padding-left: 30px;\">In his veto message, Brown said the Department of Public Health already works with employers to reduce worker exposure to lead. He said the bill would \u201cerode that collaborative approach\u201d and require the Division of Occupational Safety and Health to take immediate enforcement action. Brown said the state should instead complete its work to establish a permissible exposure level for workers and then determine the level at which immediate intervention is needed.<\/p>\n<p>The legislation resulted from a <a href=\"https:\/\/capitalandmain.com\/\">Capital and Main<\/a> investigation and subsequent <a href=\"https:\/\/www.huffingtonpost.com\/entry\/promise-breakers-how-regulators-failed-to-stop-a-sacramento_us_5949a15be4b0710bea889a3a\">media articles<\/a>\u00a0last year about exposures at a firing range and other reports about high worker lead exposures at a Los Angeles lead battery recycling plant, operated by Exide Technologies Inc.\u00a0 The information on high lead exposures wasn&#8217;t referred to CalOSHA for enforcement. The bill would have required that the health department notify Cal\/OSHA within five business days anytime it learned that a worker\u2019s blood test showed high lead levels and then require CalOSHA to initiate an investigation within 3 days.<\/p>\n<p>The California Chamber of Commerce <a href=\"http:\/\/ctweb.capitoltrack.com\/public\/publishviewdoc.ashx?di=E7aFtl92TjlY6LZZa4AZh%2fF27sV%2fylBPvoIKY%2fLRorE%3d\">opposed<\/a> the bill, arguing that lead exposures may be the result of non-workplace exposures. OK.<\/p>\n<h2>Some Good News: Living Wage in New York<\/h2>\n<p>But don&#8217;t go slit your wrists yet. There is some <a href=\"https:\/\/www.nytimes.com\/2018\/09\/27\/nyregion\/airport-workers-minimum-wage-nyc.html\">good news<\/a>:<\/p>\n<p class=\"css-xhhu0i e2kc3sl0\" style=\"padding-left: 30px;\">For years, the three main airports that serve New York City have been the site of one of the country\u2019s biggest fights over the minimum wage. A Republican governor and airline companies were pitted against Democratic officials and labor leaders over how much to pay workers who clean planes, load luggage and perform many other duties.<\/p>\n<p class=\"css-xhhu0i e2kc3sl0\" style=\"padding-left: 30px;\">On Thursday, the campaign ended in victory for as many as 40,000 airport workers who are now on a path to earning at least $19 an hour, the highest minimum wage target set by any public agency in the country. The pay increase, which was approved unanimously by the commissioners of the Port Authority of New York and New Jersey, will raise the wages of tens of thousands of workers over the next five years.<\/p>\n<p style=\"padding-left: 30px;\">\u201cThis is going to be the highest targeted minimum wage anywhere in the country,\u201d said Hector J.
