Six Supreme Court justices blocked OSHA&#8217;s vax-or-test Emergency Temporary Standard \u2013 signaling just how much they care (and understand) about protecting our nation\u2019s workers from the raging COVID-19 pandemic\u2014i.e., not much.\u00a0 In shamefully ignoring and undermining OSHA\u2019s clear statutory duty to protect workers from a recognized hazard, these justices have placed countless lives and livelihoods at risk.\u00a0 And also shown their willingness to substitute their own judgement for the expertise and authority of agencies created and entrusted with protecting our health and safety.\u00a0 For a smattering of the generated outrage and commentary, see <a href=\"https:\/\/jordanbarab.com\/confinedspace\/2022\/01\/17\/supreme-courts-disastrous-osha-decision-what-others-are-saying\/\">here<\/a>, <a href=\"https:\/\/www.nytimes.com\/2022\/01\/17\/opinion\/supreme-court-vaccine-osha.html\">here,<\/a> <a href=\"https:\/\/www.commondreams.org\/views\/2022\/01\/14\/right-wing-supreme-courts-appalling-decision-covid-safety-rules\">here<\/a>.<\/p>\n<p>Other workers are dealing with a different \u201cC\u201d hazard this past week or so.\u00a0 Like the bone-chilling <strong>COLD<\/strong> that has blasted the Northeast (a <a href=\"https:\/\/www.boston.com\/news\/local-news\/2022\/01\/15\/mayor-wu-declares-cold-emergency-in-boston-weekend\/\">cold emergency in my fair city<\/a>); the snow that <a href=\"https:\/\/www.nytimes.com\/2022\/01\/04\/us\/i-95-closed-snowstorm-winter.html\">stranded motorists<\/a> in Virginia; the deadly <a href=\"https:\/\/www.nytimes.com\/2022\/01\/16\/us\/snowstorm-updates-news.html\">winter storm that has slammed the South and Northeast<\/a>, leaving tens of thousands without power and wreaking havoc on our roadways. Think about them \u2013 working their butts off outdoors to keep us safe, warm, supplied, and in the know.\u00a0 Utility workers, snow plow operators and public road workers, emergency response crews, mail carriers, delivery workers, transportation workers, agricultural workers, and every health care warehouse, and retail worker who braved the dangerous cold, snow, and ice to get to work.\u00a0 So \u2013 when you see them, thank them \u2013 and, if they arrive at your home, offer them something warm to drink.<\/p>\n<h2><strong>So? Why Am I Thinking About Heat?<\/strong><\/h2>\n<p>Well, partly because it\u2019s cold outside and because I recognize how lucky I am to have and work from a warm home. But the real reason is because the <a href=\"https:\/\/www.osha.gov\/news\/newsreleases\/national\/12022021\">comment period for OSHA\u2019s Advance Notice of Proposed Rulemaking (ANPRM) on heat<\/a> is rapidly coming to a close.\u00a0 Comments on the ANPRM to protect indoor and outdoor workers from heat hazards must be submitted by January 26, 2022.<\/p>\n<p>I and my former colleagues at the Union of Concerned Scientists (UCS) have written previously about the occupational hazards of extreme heat and the dire need for a specific heat standard (see, for example, \u00a0<a href=\"https:\/\/blog.ucsusa.org\/kathleen-rest\/new-federal-initiative-extreme-heat-worker-protections\/\">here<\/a>, <a href=\"https:\/\/blog.ucsusa.org\/juan-declet-barreto\/as-extreme-heat-challenges-our-outdoor-workers-white-house-announcement-will-save-lives\/\">here<\/a>, <a href=\"https:\/\/blog.ucsusa.org\/james-gignac\/extreme-heat-is-a-threat-to-midwestern-outdoor-workers\/\">here<\/a>, <a href=\"https:\/\/blog.ucsusa.org\/rachel-licker\/new-ucs-climate-analysis-too-hot-to-work-shows-mounting-risks-to-outdoor-workers-from-heat-extremes\/\">here<\/a>).\u00a0 And UCS has also developed <a href=\"https:\/\/www.ucsusa.org\/resources\/participating-federal-rulemaking\">resources<\/a> and <a href=\"https:\/\/www.ucsusa.org\/sites\/default\/files\/2021-06\/Inside-the-Federal-Rulemaking-Process-6-29-21.pdf\">tools<\/a> for participating in federal rulemaking.<\/p>\n<p>It may be cold outside, but now\u2019s the time to make our voices heard on the need and our strong support for OSHA heat standard.\u00a0 Let\u2019s add another \u201cC\u201d to our list of workplace issues to take action on this week:\u00a0 COVID, COLD, AND the <strong>COMMENT <\/strong>period.<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #0000ff;\"><em>Kathleen Rest is the former Executive Director of the Union of Concerned Scientists.<\/em><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Don&#8217;t let the cold fool you.
