A cover-up of safety violations. Workers dying, with minimal penalties for employers.<\/p>\n<p>That\u2019s the kind of testimony rank-and-file workers and safety advocates brought to Washington DC last week. The occasion was a first Workers\u2019 Voice Summit convened by the U.S. Occupational Safety and Health Administration (OSHA), since OSHA&#8217;s &#8220;<a href=\"https:\/\/www.osha.gov\/news\/newsreleases\/national\/01152010\">OSHA Listens<\/a>&#8221; meeting and various <a href=\"https:\/\/www.osha.gov\/news\/newsreleases\/national\/04142010-0\">Latino<\/a> and immigrant worker conferences held during the Obama administration.<\/p>\n<p>\u201cWe know they don\u2019t treat us right, it\u2019s not safe most of the time,\u201d said Eh Phaung, a forklift operator at a mattress factory near Albany, New York. She attended the Summit with National COSH affiliate <a href=\"https:\/\/www.nenycosh.org\/\">NENYCOSH<\/a>, and said she and her co-workers face hazards from long hours and repetitive carrying and heavy lifting.<\/p>\n<p>National COSH and allies in the movement for workplace justice worked together prior to the Summit and advocated strongly for an inclusive, accessible event to genuinely represent and uplift the voices of workers who face dangerous, life-threatening hazards every day on the job. Collaborating with our COSH Network of 26 local health and safety groups, we reached out to engage workers whose voices are overlooked: Low-wage workers, temp workers, immigrants and workers of color.<\/p>\n<blockquote><p><span style=\"color: #0000ff;\"><strong>\u201cHis arm got caught there,\u201d said Miles, who had to pause to collect herself. \u201cNo safety guidelines, no training, they just placed him on the conveyor belt. Nineteen years old, he has broken every bone in his arm.&#8221; &#8212; Rebecca Miles, a worker leader from the Mississippi Workers\u2019 Center for Human Rights<\/strong><\/span><\/p><\/blockquote>\n<p>Our efforts succeeded in bringing diverse voices to the table \u2013 and workers had plenty to say.<\/p>\n<p>\u201cMy grandson works at the postal service in Jackson, sorting mail,\u201d said Rebecca Miles, a worker leader from the <a href=\"https:\/\/www.msworkrights.org\/\">Mississippi Workers\u2019 Center for Human Rights<\/a>, a National COSH affiliate based in Greenville, Mississippi. \u201cLast Wednesday, they didn\u2019t have enough employees at work, so they put him on the conveyor belt,\u201d said Miles, during an open mic session.<\/p>\n<figure id=\"attachment_6496\" aria-describedby=\"caption-attachment-6496\" style=\"width: 298px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-6496\" src=\"https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2022\/10\/Picture3-298x300.jpg\" alt=\"\" width=\"298\" height=\"300\" srcset=\"https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2022\/10\/Picture3-298x300.jpg 298w, https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2022\/10\/Picture3-150x150.jpg 150w, https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2022\/10\/Picture3.jpg 322w\" sizes=\"auto, (max-width: 298px) 100vw, 298px\" \/><figcaption id=\"caption-attachment-6496\" class=\"wp-caption-text\"><span style=\"color: #0000ff;\">Rebecca Miles, MS Workers\u2019 Center for Human Rights<\/span><\/figcaption><\/figure>\n<p>\u201cHis arm got caught there,\u201d said Miles, who had to pause to collect herself. \u201cNo safety guidelines, no training, they just placed him on the conveyor belt. I don\u2019t want this to happen to anyone else\u2019s grandson.\u201d<\/p>\n<p>A common theme was the disconnect between legal protections that exist on paper and the day-to-day reality experienced by workers.<\/p>\n<p>\u201cWhen a worker files a complaint, he gets let go or faces retaliation, and he ends up without a job,\u201d Martinez says. \u201cWhere is the justice? Where is there workers\u2019 rights? We want action, OSHA, not words.\u201d<\/p>\n<p>\u201dToo many construction workers are dropped off at the workplace with no safety information,\u2019 said Mayra Molina, a painter and worker leader from <a href=\"http:\/\/www.masscosh.org\/\">MassCOSH<\/a>. \u201cI work in construction and I see this all the time. We don\u2019t want to see this conversation just on paper, but we need action.<\/p>\n<p>\u201cA lot of times we\u2019re think we\u2019re mocked because we\u2019re strippers and sex workers and not taken seriously,\u201d said AM Davies, a leader with the California-based <a href=\"https:\/\/www.strippersunited.org\/\">Strippers United<\/a>. \u201cDirty bathrooms, broken staircases and harassment from customers are some of the problems faced by her and her co-workers\u201d, Davies said.<\/p>\n<p>\u201cOne of our colleagues in Orange County reported several OSHA violations and none of them were taken care of,\u201d she explained. Instead of fixing an unsanitary bathroom used by dancers, \u201cthe employer sent different pictures where the customers use the bathroom, and OSHA wrote it off as being fixed. They have to go back and file more OSHA complaints, and now there are even more things wrong at the club.\u201d Strippers United has been working closely with <a href=\"https:\/\/www.socalcosh.com\/\">SoCalCOSH<\/a> during their campaign to win safer working conditions and union representation at Star Garden in Los Angeles.<\/p>\n<p>In addition to specific horror stories, workers and advocates at the Summit also raised important policy issues, including the demand for immigration reform, protections for meat and poultry workers, better coverage for domestic workers, and the urgent need for protection from extreme heat.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-6497 alignleft\" src=\"https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2022\/10\/Picture1.jpg\" alt=\"\" width=\"259\" height=\"225\" \/><\/p>\n<p>Workers also came armed with solutions. \u201cAs a member of the MassCOSH worker center,\u201d said Milagros Barreto, \u201cI am here presenting the five priorities COSH and other worker center networks have identified to ensure OSHA is accessible, protects the most vulnerable workers so we can work together for jobs with dignity and our voices are heard,\u201d she said.<\/p>\n<p>Barreto presented OSHA officials with ideas for progress that were developed by COSH Network members and worker leaders in advance of the summit, including:<\/p>\n<p>\u25cf Engagement of workers and advocates as collaborators with OSHA<br \/>\n\u25cf Protection for workers from being silenced due to immigration status<br \/>\n\u25cf Enabling workers to fully participate in workplace investigations and enforcement proceedings<br \/>\n\u25cf Protections for temporary workers<br \/>\n\u25cf Collaboration with state and federal agencies to maximize worker protections, on issues such as wage theft, safe working conditions during disaster clean-up and other issues.<\/p>\n<p>Wrapping up the three-day session, Doug Parker, who heads OSHA as assistant secretary of labor for Occupational Safety and Health, said the Summit is \u201ca beginning\u2026 for all of us to work together better.\u201d<\/p>\n<p>The agency is in a rebuilding process after four years of neglect, Parker said. OSHA is now hiring more staff, conducting more inspections and carrying out more enforcement actions. The agency is focused, he said, on bringing cases against the most \u201cegregious\u201d employers with \u201cthe most willful and repeat violations that often result in the tragic death of a worker.\u201d<\/p>\n<blockquote><p><strong><span style=\"color: #0000ff;\">Language justice is essential in creating effective safety strategies; to be fully protected, workers need access to information and training in a language they can understand.<\/span> <\/strong><\/p><\/blockquote>\n<p>As COSH Network members and worker justice advocates have argued for years, language justice is essential in creating effective safety strategies; to be fully protected, workers need access to information and training in a language they can understand. So we were glad to hear Parker announce that OSHA is finally carrying out an idea that safety activists have suggested for years: a pocket card, available in English, Spanish, Chinese and Portuguese, that says:<\/p>\n<p><em>\u201cIs your employer putting your safety at risk? We\u2019re here to help you, regardless of your immigration status.\u201d<\/em><\/p>\n<p>The card will be used by OSHA inspectors, investigators, and others who interact with workers, and will be available soon in additional languages. Further efforts are needed, safety activists say, to make sure workers\u2019 voices are heard \u2013 and understood \u2013 by employers and public officials.<\/p>\n<figure id=\"attachment_6498\" aria-describedby=\"caption-attachment-6498\" style=\"width: 300px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-6498\" src=\"https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2022\/10\/nat09302022-300x200.jpeg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2022\/10\/nat09302022-300x200.jpeg 300w, https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2022\/10\/nat09302022-768x512.jpeg 768w, https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2022\/10\/nat09302022.jpeg 801w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><figcaption id=\"caption-attachment-6498\" class=\"wp-caption-text\"><span style=\"color: #0000ff;\">Assistant Secretary for Occupational Safety and Health Doug Parker<\/span><\/figcaption><\/figure>\n<p>\u201cWorkers have too little power, employers have too much,\u201d said Oscar Londono, co-executive director of <a href=\"https:\/\/www.we-count.org\/\">We Count<\/a>, a National COSH affiliate based in South Florida. \u201cWe need more worker engagement, more worker voices at the table with the Department of Labor.\u201d<\/p>\n<p>\u201cThis was a good start,\u201d said National COSH co-executive director Marcy Goldstein-Gelb, who was part of the team of safety activists helping to plan and prepare for the first-ever Worker Voices Summit. \u201cNow it\u2019s up to all of us to keep pushing and keep demanding that OSHA listen and respond to workers. When workers have a voice, we can prevent injuries and illnesses and save lives.\u201d<\/p>\n<h2>From the Communications Workers of America<\/h2>\n<p>Troy Putman, a communications tower installation crew foreman at A&amp;M Communications and a member of the<a href=\"https:\/\/cwa-union.org\/news\/releases\/tower-climbers-unioncwa-members-release-emotional-new-video-highlighting-fatalities\"> Tower Climbers Union<\/a>\/CWA; and Micki Siegel de Hern\u00e1ndez, CWA\u2019s Deputy Director for Occupational Safety and Health, participated in the three-day summit.<\/p>\n<p>Putnam explained that \u201cTower workers also face issues stemming from long hours, but that time is often spent hundreds of feet above the ground. Obviously our industry is a very dangerous, complicated industry. I\u2019m here to be a pioneer in this industry. I\u2019m passionate about it. Safety is a huge aspect we hope to fix.\u201d<\/p>\n<p>\u201cWe need the agencies to hear from the workers who are actually doing the work and that\u2019s a main reason we are here,\u201d said Siegel de Hernandez.\u00a0\u201cYou can be sure that CWA members and health and safety activists will continue to push for stronger worker protections and actions on the part of the agencies.\u201d<\/p>\n<h2>From the National Domestic Workers Alliance<\/h2>\n<p>The summit was filled with powerful testimonies from workers across a diverse array of industries, including domestic workers from across the Alliance. Domestic worker leaders raised not only the many ways in which domestic workers are excluded from basic workplace protections, but also shared impactful models to strengthen protections for this workforce like the essential workers board in Harris County TX, state level domestic worker bills of rights like in NJ, and the domestic worker health and safety oversight board in CA.
