{"id":740,"date":"2017-04-19T15:19:21","date_gmt":"2017-04-19T19:19:21","guid":{"rendered":"http:\/\/jordanbarab.com\/confinedspace\/?p=740"},"modified":"2017-04-19T15:19:21","modified_gmt":"2017-04-19T19:19:21","slug":"your-job-or-your-life","status":"publish","type":"post","link":"https:\/\/jordanbarab.com\/confinedspace\/2017\/04\/19\/your-job-or-your-life\/","title":{"rendered":"Your Job or Your Life"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-741\" src=\"http:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2017\/04\/blue_star_of_life_emtpng_square_sticker_3_x_3.jpg\" alt=\"\" width=\"225\" height=\"225\" srcset=\"https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2017\/04\/blue_star_of_life_emtpng_square_sticker_3_x_3.jpg 225w, https:\/\/jordanbarab.com\/confinedspace\/wp-content\/uploads\/2017\/04\/blue_star_of_life_emtpng_square_sticker_3_x_3-150x150.jpg 150w\" sizes=\"auto, (max-width: 225px) 100vw, 225px\" \/>I just received an invitation to a Washington DC Workers Memorial Day event titled &#8220;<a href=\"http:\/\/www.epi.org\/event\/no-worker-should-have-to-sacrifice-their-life-for-a-paycheck\/?utm_source=Economic+Policy+Institute&amp;utm_campaign=f60f9ce56e-EMAIL_CAMPAIGN_2017_03_16&amp;utm_medium=email&amp;utm_term=0_e7c5826c50-f60f9ce56e-&amp;mc_cid=f60f9ce56e&amp;mc_eid=%5bUNIQID%5d\">No worker should have to sacrifice their life for a paycheck<\/a>.&#8221;<\/p>\n<p>Scrolling further down my email, run across an article entitled: &#8220;<a href=\"http:\/\/fox59.com\/2017\/04\/17\/former-emt-says-she-was-forced-to-choose-between-job-and-safety\/\">Former EMT says she was forced to choose between job and\u00a0safety,<\/a>&#8221; \u00a0a story of\u00a0Kindsey Swim, a former Emergency Medical Technician who \u00a0quit her job after getting a call to help a patient who had previously injured her. \u00a0Swim had been hit in the head last week by a patient with Down Syndrome so hard that she went to the hospital with a concussion. \u00a0When she was told to transport the same patient the following week, she refused.<\/p>\n<p style=\"padding-left: 30px;\">&#8220;I was terrified to think that I would have to transport him,&#8221; she said. \u00a0Swim said dispatchers refused to transfer the call to other crews willing to take it, so she chose to walk away.<\/p>\n<p style=\"padding-left: 30px;\">&#8220;I chose to protect myself and I felt like I had no choice,&#8221; she said.<\/p>\n<p style=\"padding-left: 30px;\">Heartland Ambulance Service said no other crews were available and that they didn&#8217;t purposefully put her on that call. The policy, though, is if you refuse a call you&#8217;ve quit the job.\u00a0&#8220;This is not violence in EMS this is us taking care of a handicap person who does not have the same mentality as us,&#8221; company president Kenneth Jackson said.<\/p>\n<blockquote><p>Getting hurt as &#8220;part of the job&#8221; went out of fashion (and became against the law) when the Occupational Safety and Health Act was passed in 1970<\/p><\/blockquote>\n<p>In other words, as the article put it, being assaulted is &#8220;part of the job and the risks that come with it.&#8221;<\/p>\n<p><strong>Well, it&#8217;s not. \u00a0Getting hurt as &#8220;part of the job&#8221; went out of fashion (and became against the law) when the Occupational Safety and Health Act was passed in 1970 (unless you happen to be a public employee in 24 states). Even for workplace violence.\u00a0<\/strong><\/p>\n<p>OSHA publishes <a href=\"https:\/\/www.osha.gov\/Publications\/osha3148.pdf\">guidelines <\/a>to prevent violence against healthcare and social service workers, and has <a href=\"http:\/\/jordanbarab.com\/confinedspace\/2017\/03\/17\/bludgeoning-our-caregivers-workplace-violence-in-healthcare\/\">cited a number of employers<\/a> under the General Duty Clause for not providing a workplace free from exposure to workplace violence. \u00a0OSHA&#8217;s General Duty Clause requires employers to provide a safe workplace even where there is no specific standard covering the hazard. \u00a0OSHA is also working on a <a href=\"http:\/\/www.safetyandhealthmagazine.com\/articles\/15172-osha-agrees-to-pursue-standard-on-workplace-violence-prevention-for-health-care-social-services\">standard <\/a>to protect health care and social service workers against workplace violence.<\/p>\n<p>And Haley Bull, who wrote the article for Fox59 has done her research:<\/p>\n<p style=\"padding-left: 30px;\">The National Institute for Occupational Safety and Health\u00a0<a href=\"https:\/\/www.cdc.gov\/niosh\/topics\/ems\/data.html\">said in 2014<\/a>\u00a0there were more than 21,000 EMS workers treated in hospital emergency departments for injuries or illness.<\/p>\n<p style=\"padding-left: 30px;\">&#8220;The truth is that we&#8217;ve been facing these kind of dangers in the field for a very long time now,&#8221; Nathaniel Metz, president of the Indiana EMS Association, said.<\/p>\n<p style=\"padding-left: 30px;\">Metz said more training on how to de-escalate and handle violent situations is needed.<\/p>\n<p style=\"padding-left: 30px;\">&#8220;The more attention that&#8217;s brought to it the more that some key stakeholders can help educate and prepare providers in the field to handle these circumstances,&#8221; Metz said.<\/p>\n<p style=\"text-align: left;\">An EMT in New York was recently <a href=\"http:\/\/jordanbarab.com\/confinedspace\/2017\/03\/18\/killing-emt-reminds-us-dangers-public-employees-helping-professions\/\">killed on the job.<\/a><\/p>\n<p style=\"text-align: left;\">Bottom line is that no one should have to choose between their job and their life. That&#8217;s why we have the OSHAct that requires employers to provide a safe workplace. Worker also have a limited <a href=\"https:\/\/www.osha.gov\/right-to-refuse.html\">right to refuse imminently dangerous work<\/a>, although even with the law on your side, it&#8217;s\u00a0always difficult getting your job back if you get fired. Getting fired is better than not coming home at the end of the work day.
