CSB WestLast month, without any warning or explanation, Vanessa Sutherland announced her resignation as Chair of the Chemical Safety Board. Earlier this week we learned why. More money and more love.

Norfolk Southern railroad announced that Sutherland had been hired as Vice President, Legal, for the giant rail corporation. Norfolk Southern Railway Co. is a major transporter/hauler of coal and other commodities serving every major container port in the eastern United States with connections to western carriers. Headquartered in Norfolk, Va., the company employs more than 30,000 union workers.

Sutherland will likely be making significantly more money than her position as CSB chair, but it’s not likely that her job will be any easier.

Although the company seems to have cleaned up its act, from 2011 through 2013 OSHA ordered Norfolk Southern to pay compensatory and punitive damages to workers totaling well over $4 million for violating workers’ rights under the whistleblower provisions of the Federal Railroad Safety Act (FRSA).   OSHA has no authority over safety and health conditions of America’s rail workers, but the FRSA gives OSHA authority over whistleblower provisions of the law.

Here’s are a couple of typical cases:

  • On May 13, 2009, the employee was initially injured in Jamestown, N.C., while removing a spike from the rail line. Fearing loss of employment, the worker did not report the injury until a re-injury occurred in October when, at the suggestion of management, the employee saw a doctor. After returning to work, the employee was suspended and later terminated for allegedly falsifying the injury. The employee submitted a complaint to OSHA and the agency’s investigation determined that not only were the employee’s rights under the FRSA violated, the company also successfully intimidated other employees from reporting on-the-job injuries. This “chilling effect” allowed Norfolk Southern to maintain the appearance of an exemplary safety record and continue its 22-consecutive-year record as recipient of the E.H.Harriman Gold Medal Rail Safety Award.
  • A laborer based in Greenville, S.C., was terminated on Aug. 14, 2009, after reporting an injury as a result of being hit by the company’s gang truck. The railroad charged the employee, a laborer, with improper performance of duties. OSHA found that the employee was treated disparately in comparison to four other employees involved in the incident. The laborer was the only employee injured and, thus, the only employee who reported an injury. He also was the only employee terminated.

Happily, things seem to have calmed down since then. Hopefully Sutherland can help keep them that way.

Sutherland’s Legacy

Sutherland joined the CSB in 2015 promising to calm the waters of the troubled agency and reduce the backlog of unfinished reports that then stood at six. But as Jeff Johnson notes in Chemical and Engineering News, staff morale problems may be getting worse, and

Now, as Sutherland departs, nine accident reports are in process, three more than when she arrived. One of these occurred in 2014, before she took over the board. That accident at a DuPont site involved a chemical process mix-up in which methyl mercaptan was accidentally released, killing four workers. The incident led the Occupational Safety & Health Administration (OSHA) in 2015 to label DuPont a severe violator of workplace safety regulations, a consequence that increased enforcement scrutiny and fines. However, CSB has yet to finalize its interim accident report.

After Sutherland’s departure, Board member Dr. Kristen Kulinowski was named the agency’s Interim Executive Authority.

On Her Way Out the Door

One of Sutherland’s last acts was the final removal of Dr. Daniel Horowitz, who had been CSB Managing Director under former Chair, Dr. Rafael Moure-Eraso. Moure-Eraso resigned in 2015 while under investigation by Congress and the Inspector General for mismanagement of the agency, abuse of power, employee retaliation, lack of honesty in his communications with Congress and use of personal email accounts for agency business. Horowitz had been on administrative leave since Moure-Eraso’s resignation.

Meanwhile, President Trump has proposed for the second year in a row that the small agency be eliminated and although it is unlikely that Congress will go along, constant threats of execution by firing squad can’t be good for staff morale or the agency’s ability to fill vacancies.

  1. Just for the record: concerning CSB management (or “mismanagement”), there were 22 open investigations when Moure-Eraso took office in 2010, but only six open cases when he left in 2015. In 2015 there were about 20 CSB investigators on staff, which was similar to when he started, because he actually hired people to replace those lost through attrition. As for the other matters, all allegations that Moure-Eraso had misled Congress were dropped in 2017, and after several lengthy investigations the independent Office of Special Counsel never found there was any actual whistleblower retaliation or prohibited personnel practices at the Board during that time.

      How many CSB Investigations were completed (2010-15)?
      There were 22 unfinished investigations in 2010 when a new Chairperson came to CSB. From 2010 to 2015 there were 12 new deployments —initiated de novo by the new CSB Board–for a total of 34 to be managed on this period. By April 2015 there were left six pending investigations. So the investigations completed in this period are a total of 28 and included: legacy investigations from the 22 unfinished by 2010 and the new 12 deployments in the 2010-15 period.
      The point is that on top of the 22 legacy investigations the board had to deploy and finish 12 additional investigations. In April 15, 2015 there were only 6 investigations pending.
      Not all investigations require the same resources or have the same levels of complexity. There is not comparison between –for example: the Macondo -Deepwater-Horizon Fire and explosion investigation (it took five years and cost more than $4 millions dollars) and the investigation in Kleen Energy (CT) that took a few months to complete with a cost of less than $400,000.

  2. Confined Space reported in June 27, 2018 on allegedly misdeeds of the CSB being investigated once upon a time. The particulars were obtained by copying -verbatim from other publication (J. Morris, The Center for Public Integrity.03/27/15) on a list ranging from CSB’s” mismanagement” to use of “emails for agency business.” That list was generated by members of the US House of Representatives Oversight and Government Reform Committee in the report of the hearing conducted on the CSB in 2014. That hearing account was examined by impartial reporters that described it as a partisan non-credible document (see: Bloomberg-BNA, Right to Know Planning Guide Report VOL 28, No 14-Special Report on the CSB on 7-10-2014). The assertions of the committee staff (Ranking member’s staff) –reported by the BNA– revealed the unfairness and political bias of the findings who aimed to discredit the CSB management and thus the work of the agency.
    Journalist cannot be oblivious of the consequences of the message they transmit. Simply reporting claims of accusers without any critical analysis of its veracity has gotten us on the pathway to “fake news.” The same goes with not reporting on the final disposition of the allegedly misdeeds being investigated. Simple accounts on the existence of investigations and not on their final outcomes not only damages reporter’s credibility but also allow unfair damage to reputations of the persons and entities being investigated.
